TERMS AND CONDITIONS

The Terms and Conditions in this contract apply to all participants of Nossa Terra Tours.

Please read and sign below.

Our Terms And Conditions including all documents, correspondence and the Terms and Conditions of our suppliers form the basis of our contract with you.

Paying your deposit and submitting your registration form indicates that you acknowledge you have read and accept the Terms and Conditions of this contract.

PHYSICAL REQUIREMENTS

You agree that you meet the physical requirements to participate in our tour(s) and the obligations in connection with your participation, and that the information supplied by you is current and correct.
If not, it could lead to:

(a) Cancellation of your booking / purchase

(b) Forfeiture of payment(s) made for your reservation or tour

CONTAGEOUS DISEASES

We do all possible to help avoid the risk of exposure, however:

You acknowledge and assume the risk of exposure or infection.
If necessary, the tour may be postponed or canceled if locations are closed (for example in the event of a lockdown).

TRAVEL INSURANCE

We highly recommend “Cancel For Any Reason” (CFAR) travel insurance and medical coverage for all participants on our tour.
CFAR insurance usually needs to be purchased within two weeks of your initial payment (i.e. your deposit).
If you require proof of payment or similar documentation, please let us know so we can provide whatever is needed.

BOOKING / PAYMENTS / REFUNDS / CANCELLATION

Bookings are confirmed once your deposit is received.
You will receive an invoice for the final payment due.
Refund and cancellation policies are outlined below:

CANCELATION / REFUND POLICY

150 days + : 75% refund (deposit is non-refundable)

149- 90 days : 50% refund, (deposit is non-refundable)

90 days or less: No refund

LODGING / ACCOMMODATIONS

We offer the best accommodations available in the area and dates of your tour.

We will always convey special requests to the lodges but cannot always guarantee availability of special requests.
Unforeseen circumstances, such as road closures, flooding or ‘Acts of God’) may require us to substitute lodging, in which case we will do everything possible to maintain the same type of property and room. To protect the safety and comfort of our tour participants, substitutions may occur at the last minute.

TRANSPORTATION

We provide all transportation outlined in your itinerary, including transfers to and from the airport, car / van, boat and drivers.
If your travel plans change, please advise us, we will do our best to accommodate, however some cases may result in an additional cost.
Ground transportation may include long distances on unpaved / uneven dirt roads.
We may travel in 4x4 vehicles, and travel in these vehicles may take longer depending on road and weather conditions.
Please confirm that you are able to travel for long-hours in an SUV, 4x4 or Van, for the tour and in unforeseen conditions.

MEALS

All meals: breakfast, lunch, and dinner and water are included (except when otherwise noted in your itinerary).
Special diets, dietary restrictions and allergies should be communicated at the time of booking and we will ensure the lodges are aware of your dietary requests.
We will do everything possible to ensure your requests are honored.

THIRD PARTY SUPPLIERS

Our employees, owners, agents, and representatives may use third party suppliers for transportation, guiding, lodging, and other services related to this tour.
Nossa Terra Tours is not an employee, agent, or representative of any of these suppliers.
Nossa Terra Tours does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour.
All suppliers are independent contractors and are not agents or employees or representatives of Nossa Terra Tours.
All participants agree that Nossa Terra Tours, its owners, agents, or representatives are not liable for any loss, injury, or damage to any tour participant or their belongings resulting from an occurrence beyond our control.
Participants agree that Nossa Terra Tours is not responsible or liable for lost, stolen or damage to personal items, trip delays or interruption due to a vehicle malfunction, labor strike or dispute, ‘Acts of God’, changes to government police, fires, war, terrorism, insurrection, riot, theft, epidemic, illness, physical injury, customs or immigration regulations, or any unforeseen matter that might cause a delay or change to the original tour schedule or a participants’ anticipated outcome.

Nossa Terra Tours assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any participant that may result from any act or omission on the part of others.

TRAVEL DOCUMENTATION

To avoid any issues while traveling internationally, please ensure your travel documents, passports or visas (if applicable) are current and valid for at least six months after the tour date.

NON-GUARANTEE OF WILDLIFE

We will do our best to achieve our target wildlife photos, but we cannot guarantee wildlife sightings or predict wildlife behavior.
We will do our best to assist you in getting the best photo possible but cannot guarantee your photos will represent what hoped or expected to capture while onsite.
We will make every effort to provide the best photographic opportunities, lighting, weather, animal, bird, reptile, or other species but these opportunities may be compromised by the subject’s behavior, weather, ‘Acts of God’, unexpected events that force a change to our travel schedule.

ACKNOWLEDGEMENT OF RISK

As a participant in our tours or workshops, you understand and acknowledge that your tour may involve some risk and potential exposure to injury or worse. You also acknowledge that risk and dangers might be caused by negligence, fault or wrongdoing of owners, employees, contractors or other participants, contractors and/or subcontractors of Nossa Terra Tours. Risk and dangers may arise from foreseeable and unforeseeable causes. You acknowledge that risks, dangers and hazards exist in connection with your tour or workshop.

In recognition of the inherent risk of the travels and related activities that you intend to engage in, you confirm that you are physically and mentally capable of participating in our tour and activities, that you are willingly and knowingly electing to participate in this tour in spite of the potential risk of danger, and you knowingly, willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, whether caused in whole or in part by negligence, fault or wrongdoing, of the owners, employees, contractors, or subcontractors of Nossa Terra Tours or of other participants. You understand and acknowledge that due to the remoteness of where we travel, emergency evacuation and/or search and rescue may be delayed or unavailable and that medical facilities and supplies may be limited. You also acknowledge that it is your responsibility to assess the impact such limitations may have on any pre-existing medical condition(s).

You understand and acknowledge that Nossa Terra Tours reserves the right to accept or reject any participant for reason. We and our guides have the right to disqualify you from any trip activity for inappropriate behavior, or, if in our judgement you are unable to perform that activity and / or your continued participation would endanger you or the safety of anyone in the group or the group as a whole.

It is your responsibility and obligation to inform Nossa Terra Tours at the time of your reservation of any medical or physical or mental disabilities. This includes food allergies or limitations that might disable you or render you unable to safely complete the tour or any activity during the tour.

You further acknowledge that you are the best judge of your own conditions and limitations, and that it is your responsibility to fully disclose the full extent of any conditions or limitations in advance to Nossa Terra Tours

RELEASE OF LIABILITY

In consideration of the Services and arrangements provided by Nossa Terra Tours, for yourself and for your heirs, personal representatives or assigns, you hereby release, waive, discharge, hold harmless and agree to indemnify Nossa Terra Tours, their owners, agents, employees, contractors, subcontractors and affiliates from any and all claims, actions, or losses for bodily injury, emotional injury or distress, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with Nossa Terra Tours’ services and any activities conducted in conjunction with them.
